Laws and Regulations

​​​The IDF and Defense Establishment Archive is a state archive, subject to the laws of the State of Israel. The following laws influence the archive's work, scrutinizing and usage possibilities.

  1. The Archives Law – 1955

The Law defines the archive's activity fields and obligations, regarding, inter alia, material archiving, usage and evaluation. The documentation stored in the IDFA was created in the defense establishment, and therefore is subject to the Archives Law, it is classified for 50 years from its creation, unless the depositor sets a shorter limitation schedule. In 1994 the law was amended to allow a scrutiny of classified material at the discretion of the Restricted Materials Scrutinizing Committee.

    The Privacy Protection Law – 1981 

The documentation stored in the archive contains, naturally, personal and private information of Israel's citizens. Subject to the Privacy Protection Law, the IDF and Defense Establishment Archive is obligated to bar any information which might injure the privacy of Israel's citizens, before its declassification.

Basic Law: Human Dignity and Liberty – 1992

Section 7 of the law deals with privacy and intimacy: "There shall be no violation of the confidentiality of conversation, or of the writings or records of a person." Therefore the IDF and Defense Establishment Archive removes any information which may injure the privacy of any Israeli citizen, before its declassification.

Any usage of documentation in the IDF and Defense Establishment Archive is subject to the copyrights of various authors, photographers, researchers etc. as defined by the law.

The Freedom of Information Law – 1998

The law expresses the public's right to receive information. However, although the law is not effective for archival materials, the IDF and Defense Establishment Archives, as an information supplier, is aware of its duty to pass information to the public, subject to the law and its regulations.

In addition to the Freedom of Information Law, a Freedom of information decree was issued, detailing subject about which no information may be supplied for reason of "State Security."

General Staff Orders

The IDF and Defense Establishment Archive is working in coordination with the IDF. General Staff Orders 30.0601, 30.0602, 30.0603, 30.0408 regulate the working relations between the IDF and Defense Establishment Archive and military units in everything associated with running the mili​tary office, filing, and archiving, as well as with scrutiny regulations of military entities.

Ministry of Defense Guidances  2017

The IDF and Defense Establishment Archive is subject to the Ministry of Defense guidances. Guidance 5​9.140​ relates to dealing with scrutiny requests of classified archival matters. Guidance 59.02 related to scrutinizing archival materials open to the public in the IDF and Defense Establishment Archives.
